Buying a Condo in South Florida in 2026: The Milestone Inspection and Reserve Study Papers to Request First
Florida's condo safety rules now affect monthly fees, financing, insurance and even whether a deal closes. That is the message of a guide by Fort Lauderdale REALTOR Mary Gallo published October 19, 2026. If you plan to buy a condo in Miami Beach, Aventura, Fort Lauderdale or anywhere in South Florida, here is the paperwork to request before you commit.
What a milestone inspection is
A milestone inspection is a structural evaluation required for condo and co-op buildings three stories or taller. It is triggered when a building reaches 30 years of age, or 25 years in some coastal areas, and it repeats every 10 years. The guide points to Florida Statute 553.899 for the framework.
Phase one is a visual examination of structural components, including load-bearing walls. A phase two inspection is required only if substantial deterioration is found, and it may involve more invasive testing.
What a reserve study covers
A Structural Integrity Reserve Study, called a SIRS, is a professional study of the parts of a building that keep it standing and watertight. According to the guide, it must address the roof, load-bearing walls, foundation, floors, exterior painting and waterproofing, windows and exterior doors, plumbing, electrical, and fireproofing and fire safety systems.
It also covers any other component with a deferred maintenance or replacement cost over $25,000 whose failure could affect structural integrity. The guide adds that associations generally may not waive or reduce reserve funding for these structural items. In the past, many boards voted to waive reserves to keep fees low.
The December 31, 2026 date
The guide says that by December 31, 2026, most associations must complete their first SIRS and, for many buildings, their initial milestone inspection. The original deadlines came from SB 4-D in 2022, and later updates, including HB 913 signed in 2025, pushed key dates back. That date tells you whether a building's paperwork is complete, in progress or behind.
The documents to request
During your due diligence period, ask for the milestone inspection report if one has been completed, the SIRS, the reserve funding statement, recent board meeting minutes and the association's insurance details. These papers show the true cost of owning the unit, not only the purchase price.
Lenders are paying attention too. The guide says lender questionnaires now routinely ask whether the building has completed its milestone inspection and whether reserves are adequately funded. A building that cannot answer yes may find conventional financing harder to get, which can stall your loan.
What it can mean for your monthly cost
Fully funded reserves usually mean higher monthly fees. Buildings that waived reserves for years are often catching up, and underfunded buildings may levy special assessments to pay for repairs found in an inspection or study. The guide warns that a surprise five figure assessment is nobody's idea of a warm welcome, so ask about assessments early.
Insurance is part of the picture. The guide says insurers now look closely at milestone results, reserve funding and overall building safety when they write or renew association master policies. Ask what the master policy covers and when it renews.
Use the paperwork in your negotiation
Buyers in these markets are already negotiating. Redfin's September 2026 data show a sale to list price ratio of 93.2 percent in Miami Beach and 93.1 percent in Aventura. Bridge Point Business and Real Estate Advisors, summarizing Florida Realtors data, reports condo supply of 7.7 months in the third quarter against 4.4 months for single-family homes.
With that much room, a building with missing reports, open repairs or an underfunded reserve is a fair reason to ask for a lower price, a credit or a longer review period. It is also a fair reason to walk away. Have an attorney or qualified professional review the documents with you.
